Partner visas

Partner visas program is for people who are married, in de facto relationship, in interdependent relationship or engaged to be married to an Australian citizen, Australian permanent resident or eligible New Zealand citizen. These visas allow to enter and/or to remain permanently in Australia.

For Partner visas you need to satisfy the following requirements:

  1. You must be aged 18 or over

  2. Your relationship must be genuine and continuing

  3. If you are engaged to be married, you must have a genuine intention to marry and live with your partner

  4. If you are in married, de facto or interdependency relationship you must show that your have been in a relationship for 12 months before you lodge application for a partner visa and both have a genuine commitment to shared life together

  5. You must meet health and character requirements

  6. Your partner must be eligible person and prepared to sponsor you

Partner visa subclasses

There are two stages (temporary/provisional - permanent) to the application process in Partner visa program, which also defer whether you are applying from outside or inside Australia.

Prospective Marriage (temporary) subclass 300 visa
This visa is temporary visa designed for individuals that are engaged to be married and are planning to marry in Australia with an Australian citizen, Australian permanent resident or eligible New Zealand citizen. This visa application must be made from outside Australia. This visa is valid for 9 months, in this period partners must enter Australia and marry, and further apply for the Spouse subclasses 820/801 visa.

Spouse (provisional) subclass 309 visa
This provisional visa is designed for individuals that are married or in de facto relationship with an Australian citizen, Australian permanent resident or eligible New Zealand citizen and are applying form outside Australia. This visa application must be made from outside Australia. This visa is valid for two years. After this period if the relationship is assessed as still genuine and ongoing, the person is able to apply for a permanent Spouse (migrant) subclass 100 visa.

Spouse (migrant) subclass 100 visa
This permanent visa is designed for the applicants that had been previously approved Spouse (provisional) subclass 309 visa. This visa will be granted if the relationship is assessed as still genuine and ongoing.

Interdependency (provisional) subclass 310 visa
This provisional visa is designed for individuals living in interdependent relationship including same-sex partnership with an Australian citizen, Australian permanent resident or eligible New Zealand citizen. This visa application must be made from outside Australia. The partners must be in interdependent relationship for the entire 12 months prior to the date of the application. This visa is valid for two years. After this period if the relationship is assessed as still genuine and ongoing, the person is able to apply for a permanent Interdependency (migrant) subclass 110 visa.

Interdependency (migrant) subclass 110 visa
This permanent visa is designed for the applicants that had been previously approved Interdependency (provisional) subclass 310 visa. This visa will be granted if the relationship is assessed as still genuine and ongoing.

Spouse (temporary) subclass 820 visa
This visa is temporary visa for individuals that are married or in de facto spouse relationship for at least 12 months prior to application. This visa application must be made from inside Australia. This visa is valid for two years. After this period if the relationship is assessed as still genuine and ongoing, the person is able to apply for a permanent Spouse (residence) subclass 801 visa.

Spouse (residence) subclass 801 visa
The permanent visa designed for the applicants that have been approved Spouse (temporary) subclass 820 visa. This visa will be granted if the relationship is assessed as still genuine and ongoing.

Interdependency (temporary) subclass 826 visa
This visa is a temporary visa designed for individuals that have been in interdependent relationship for the entire 12 months prior to the date of the application. This visa application must be made from inside Australia. This visa is valid for two years. After this period if the relationship is assessed as still genuine and ongoing, the person is able to apply for a permanent Interdependency (residence) subclass 814 visa.

Interdependency (residence) subclass 814 visa
This permanent visa is designed for individuals that have been previously approved Interdependency (temporary) subclass 826 visa and have been in interdependent relationship for two years after first applying for the Interdependency (temporary) subclass 826 visa.

Application Costs and Processing times

Partner visas are subject to the Department of Immigration and Citizenship (DIAC) application fee of currently AUD $2,525 currency converter (when applied within Australia).

Application fee when applying from outside Australia is currently: AUD $1,705 currency converter

Prospective marriage (fiance) visa applications are subject to the Department of Immigration and Citizenship (DIAC) fees of AUD $1,705 currency converter. Later with application for the Spouse visa further payment of AUD $825 currency converter or AUD $1040 currency converter is required.

Processing times vary depending on personal circumstances of the applicant and the country, where application is lodged. Prospective marriage (fiance) visa applications are processed in several weeks. For other partner visas processing times are approximately 3 to 9 months.

457 visa integrity reforms 14 September 2009
The below reforms are designed to enhance the integrity of the program and ensure the program continues to provide the necessary skills.
These reforms include:
-a new Sponsorship Obligations regime
-a new system for the payment of salary to Subclass 457 visa holders
-a stronger sanctions regime, including civil penalties
-new arrangements for the payment of health costs for 457 visa holders.


Students and GSM
The criteria for grant of GSM visas will be continusly changing in response to the changing economic circumstances of Australia. International students should note that any changes to the criteria for the grant of a GSM visa would not affect their Student visa conditions. But students should not make educational choices solely on the basis of hoping to achieve a particular migration outcome, as the GSM program will continue to change and adapt to Australia’s economic needs.
